“Worlds Apart” – a cartoon that illustrates the challenges to innovation if the government becomes the agent to regulate AI engines.

In response to the clamor by industry insiders and political operatives, last week the US Commerce Department issued a formal public request for comment on accountability measures for technology that includes new AI models.

Such models would be required to go through a certification process before they are released.

However, whether it is at the policy curation stage or the certification processing once a policy turns to law, the government might not be the answer.

As an example, Representative Jay Obernolte, a California Republican (and Congress’s only member with a master’s degree in A.I.) remarked “you’d be surprised how much time I spend explaining to my colleagues the chief dangers of A.I. will not come from evil robots with red lasers coming out of their eyes.”

Perhaps a better solution is a public/private partnership since the real task for AI regulation is to create a rules structure that both protects the public and promotes industry innovation—not to trade off one against the other.

One good example of a successful public/private partnership managing the introduction of a new technology is the approach taken around cyber security, while a poor example is the approach the regulatory bodies are taking with the blockchain industry.
